Prime Medical College Journal (PMCJ) Publishers – Standard Terms and Conditions
The Prime Medical College Journal (PMCJ) grants the Licensee a non-exclusive and non-transferable right to provide Authorized Users with online access to PMCJ journals, including subscribed journals and individual papers purchased by the Licensee (referred to as “Licensed Materials”). This access is strictly for research, teaching, and private study purposes. For permissions beyond this scope, please contact [email protected].
Definitions
Authorized Users: Includes current faculty, staff, consultants, contractors, registered students, and individuals authorized to use the Licensee’s library services. Access is authenticated either on the library premises or remotely through designated systems.
Commercial Use: Use of Licensed Materials for monetary gain, excluding direct costs incurred by the Licensee.
Course Packs: Collections of materials compiled by Authorized Users for instructional purposes.
Electronic Reserve: Electronic copies of materials stored on a Secure Network for use in specific courses.
Secure Network: A restricted network accessible only to Authorized Users through authenticated login credentials, managed by the Licensee.
Licensee’s Rights and Responsibilities
The Licensee may:
Allow Authorized Users access to the Licensed Materials through the Secure Network.
Provide indexes of authors, article titles, abstracts, and keywords for the Licensed Materials.
Provide single printed or electronic copies of articles to Authorized Users upon request.
Display, download, or print Licensed Materials for internal use, marketing, testing, and training.
Include Licensed Materials in Course Packs and Electronic Reserve, ensuring appropriate acknowledgments.
Authorized Users’ Rights
Authorized Users may:
Search, view, retrieve, and display Licensed Materials.
Save articles, extracts, or search results electronically for personal use.
Print single copies of articles, extracts, or search results.
Distribute single copies of articles or extracts to other Authorized Users.
Restrictions
Without prior written consent from PMCJ, neither the Licensee nor Authorized Users may:
Remove or alter author names, copyright notices, or identification marks.
Distribute Licensed Materials on any network other than the Secure Network.
Use, print, resell, or republish Licensed Materials for Commercial Use.
Systematically distribute Licensed Materials to individuals other than Authorized Users.
Publish, distribute, or create derivative works based on Licensed Materials.
Alter, adapt, or modify Licensed Materials beyond necessary adjustments for digital display.
Warranties and Indemnification
PMCJ warrants that Licensed Materials do not infringe any copyright or proprietary rights. PMCJ indemnifies the Licensee against legal actions claiming such infringement, except where the Licensee has altered the Licensed Materials beyond the permitted scope.
PMCJ reserves the right to withdraw Licensed Materials deemed infringing, defamatory, obscene, unlawful, or objectionable.
Liability
PMCJ shall not be liable for any damages arising from the use or inability to use the Licensed Materials. Liability for claims or losses due to a breach of this License is limited to the subscription fee paid by the Licensee.
Termination
Upon termination of this License, the Licensee may retain access to Licensed Materials for the subscription period already paid.
Termination may occur due to a material breach by either party. All rights and obligations under this License cease upon termination, except for continued access to permitted materials.
General Terms
The Licensee must ensure that only Authorized Users access Licensed Materials and report any unauthorized use immediately.
Notices between PMCJ and the Licensee shall be sent to the designated addresses.
This License is governed by the laws of Bangladesh, and any disputes are subject to the jurisdiction of courts in Rangpur.
